1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and Flagit ("Company", "we", "us", or "our") governing your use of the Flagit software, the website at flag-it.dev, the customer portal at portal.flag-it.dev, and related services (collectively, the "Service").

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Service.

2. Description of Service

Flagit is a self-hosted feature flag management platform. The Service includes:

• Flagit Software: The self-hosted feature flag server and dashboard that you deploy on your own infrastructure.
• Licensing Portal: The customer portal for managing your account, licenses, and activations.
• Documentation: Technical documentation, guides, and SDKs.
• Support: Technical support according to your license tier.

3. License Tiers

3.1 Community License (Free)

The Community license is free for evaluation and small-scale use. It includes:

• Up to 5 feature flags
• Up to 2 environments
• Up to 1 project
• Up to 3 users
• Community support (forums, documentation)

3.2 Pro License

The Pro license is for teams and includes:

• Unlimited feature flags
• Unlimited environments
• Unlimited projects
• Unlimited users
• 1 organization
• User targeting and segments
• Scheduled releases
• Audit logging
• Email support

3.3 Enterprise License

The Enterprise license is for organizations needing multi-tenancy or advanced features. It includes all Pro features plus customizable options:

• Multiple organizations (quantity based on your needs)
• Single Sign-On (SSO) support
• Webhooks
• Priority support
• Custom SLA available

4. Account Registration

To access certain features of the Service, you must register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms or contain false information.

5. Payment Terms

5.1 Pricing

Current pricing is displayed on our website and portal. Prices are subject to change with 30 days notice. Your renewal price will be the price in effect at the time of renewal.

5.2 Payment Processing

All payments are processed securely through Stripe. By providing payment information, you authorize us to charge your payment method for the fees due. We do not store your credit card information.

5.3 License Term and Renewal

Pro and Enterprise licenses are sold as one-time purchases valid for one year. Licenses do not auto-renew. Before your license expires, we will send you a reminder email with renewal options. You may choose to renew at the current pricing or let the license expire.

5.4 Refunds

We offer a 14-day money-back guarantee for new purchases. If you are not satisfied with your purchase, contact us within 14 days for a full refund. Refunds are not available after the 14-day period or for renewals.

6. License Grant

6.1 Grant of License

Subject to these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable license to use the Flagit software for your internal business purposes during the license term.

6.2 License Restrictions

You may not:

• Sublicense, sell, resell, or redistribute the software (except under Enterprise multi-tenant license)
• Modify, adapt, or create derivative works of the software
• Reverse engineer, decompile, or disassemble the software
• Remove or alter any proprietary notices or labels
• Use the software to develop a competing product
• Share your license key or allow unauthorized access

6.3 License Activation

Your license must be activated on a specific server instance. Pro licenses allow 1 activation (1 server). Enterprise licenses may include multiple activations as agreed. Contact us for additional activations.

7. Self-Hosted Deployment

Flagit is self-hosted software that you deploy on your own infrastructure. You are responsible for:

• Providing and maintaining suitable server infrastructure
• Installing, configuring, and updating the software
• Backing up your data
• Securing your deployment (network, access controls, etc.)
• Ensuring compliance with applicable laws regarding data you process

We do not have access to your deployed instance or the data processed by it. You are the data controller for any personal data processed through your Flagit deployment.

8. Intellectual Property

The Service, including all software, documentation, content, trademarks, and other intellectual property, is owned by Flagit and protected by copyright and other intellectual property laws.

Your license does not grant you any ownership rights in the software. All rights not expressly granted are reserved by Flagit.

9. Acceptable Use

You agree not to use the Service to:

• Violate any applicable law or regulation
• Infringe the intellectual property rights of others
• Transmit malware or harmful code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Use automated means to access the Service without permission
• Engage in fraudulent or deceptive practices

You agree to indemnify, defend, and hold harmless Flagit and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any data processed through your deployment of the software

14. Termination

14.1 Termination by You

You may terminate your account at any time by contacting us. Upon termination, your license will expire and you must stop using the software.

14.2 Termination by Us

We may terminate or suspend your account immediately, without prior notice, if:

• You breach these Terms
• You fail to pay fees when due
• We are required to do so by law
• We discontinue the Service (with 90 days notice)

14.3 Effect of Termination

Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive will survive termination, including intellectual property, warranty disclaimers, limitation of liability, and indemnification.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or by posting a notice on our website at least 30 days before the changes take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the new Terms.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of Slovenia, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Slovenia.

17. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and Flagit regarding the Service.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• Waiver: Failure to enforce any right does not constitute a waiver of that right.
• Assignment: You may not assign these Terms without our consent. We may assign our rights freely.
• Force Majeure: We are not liable for delays or failures due to events beyond our reasonable control.
